1. About These Terms

These Terms of Service (“Terms”) govern your use of abiotp.store (“Site”)—currently a pre-launch “work in progress” page—and future post-launch use (including product purchases, account access, and store interactions). By accessing the pre-launch page, subscribing to launch notifications (once available), creating an account (post-launch), placing an order, or engaging with any Site features, you (“you”, “User”, “Customer”) agree to be bound by these Terms. If you do not agree to all Terms, you may not use the Site.

These Terms apply to all users, including pre-launch subscribers, post-launch customers, and anyone accessing the Site on behalf of a business (e.g., purchasing for an office). If using the Site for a business, you represent you have authority to bind the business, and “you” refers to the business.

These Terms incorporate our Privacy Policy, Shipping Policy (post-launch), and Return Policy (post-launch)—in case of conflict, the referenced policy controls for that specific matter.

2. Eligibility to Use the Site

To use the Site (pre-launch or post-launch), you must meet the following requirements:

3. Pre-Launch Site Use

  • Content Limitations: The pre-launch page is for informational purposes only—no products, services, or purchases are available yet. All pre-launch content (e.g., graphics, teasers once added) is our intellectual property and may not be copied, distributed, or modified without our written permission.
  • Subscription Rules (Once Available): Submitting your email to the pre-launch form means you consent to receive launch-related communications—you can unsubscribe anytime via the “Unsubscribe” link in emails. We do not guarantee early access, specific offers, or launch timelines (which are subject to change).
  • Prohibited Pre-Launch Activity: You may not spam the subscription form (e.g., submitting multiple emails to receive duplicate alerts), attempt to bypass site security (e.g., hacking the pre-launch page), or share misleading information about the Site (e.g., fake launch dates or product details).

4. Prohibited Uses of the Site (Pre-Launch & Post-Launch)

You may not use the Site for unlawful, fraudulent, or abusive purposes. Specifically, you agree not to:

  • Unlawful Activity: Use the Site to facilitate money laundering, identity theft, or other illegal acts (e.g., using stolen credit cards for post-launch purchases) or bypass site security via hacking, phishing, or other unauthorized methods.

4.2 Misuse the Site or Services

  • Resell Without Permission: Resell, distribute, lease, or rent post-launch products for commercial purposes (e.g., buying bulk items to sell on eBay) without our explicit written consent. To apply for a reseller program, contact support@abiotp.store.
  • Harm Site Functionality: Transmit viruses, malware, or destructive code (e.g., uploading a virus to a post-launch product review); access restricted areas (e.g., admin panels, database servers) without authorization; or use automated tools (bots, scrapers) to extract data (e.g., pre-launch visitor metrics, post-launch product prices) or automate purchases (e.g., buying limited-edition items via bots).
  • Disrupt User Experience: Overload servers with excessive requests (e.g., spamming the pre-launch subscription form); manipulate post-launch search results (e.g., fake reviews to boost a product); or harass other users/support staff (e.g., sending abusive emails about launch delays or product issues).

4.3 Engage in Fraudulent or Abusive Behavior

  • Fraudulent Orders: Place post-launch orders using stolen payment methods, fake addresses, or duplicate accounts to manipulate inventory; claim non-receipt of delivered products.
  • Abuse Policies: Return used/worn post-launch products as “unused”; exploit pre-launch updates (e.g., creating multiple accounts to receive duplicate launch offers); or file unjustified chargebacks (e.g., claiming a product is defective when it was damaged by misuse).

Consequences of Violation: Breach of any prohibited use will result in immediate termination of your Site access. You will be liable for any damages we incur (e.g., legal fees for copyright infringement, costs to repair a hacked server). We may report serious violations (e.g., fraud, hacking) to law enforcement.

5. Post-Launch Product Information & Pricing

Once the Site launches, we will provide accurate product details, but note the following:

5.1 Product Descriptions

We strive to provide detailed, accurate descriptions (materials, dimensions, functionality, care instructions) for post-launch products. However, minor inconsistencies may occur:

  • Material Variations: Descriptions may use general terms (e.g., “cotton shirt”) unless a specific material is stated (e.g., “100% organic cotton shirt”).
  • Color Differences: Product colors may vary due to manufacturing batches or device monitor settings—we use natural light photos to minimize this.
  • Dimensions: Sizes are approximate (±0.5 inches for small items, ±1 inch for larger items) due to manual measurement.

Contact support@abiotp.store with product questions (e.g., “Is this item machine-washable?”) before purchasing. We are not liable for misunderstandings from minor inaccuracies unless the error is intentional or due to gross negligence.

5.2 Pricing

  • Currency: All post-launch prices are displayed in U.S. Dollars (USD) unless stated otherwise. International users may incur currency conversion fees from their payment provider—we are not responsible for these fees.
  • Inclusions/Exclusions: Prices include the product but exclude sales tax (calculated at checkout based on your delivery address), shipping fees (see Shipping Policy), and customs duties (for international orders).
  • Price Changes: We reserve the right to adjust prices post-launch (e.g., due to material cost increases, sales)—changes do not affect confirmed orders.
  • Price Errors: If a product is mispriced (e.g., a $120 item listed as $12) due to a typo/technical error, we may cancel the order, refund payment, and offer to reprocess at the correct price. We notify you of errors within 24 hours of order placement.
  • Promotions: Post-launch discounts, coupon codes, and sales are valid for the stated period and may have restrictions (e.g., minimum purchase, excluded products). We reserve the right to cancel promotions if abused (e.g., sharing codes publicly).

6. Post-Launch Order Placement & Confirmation

6.1 Order Process

When you place a post-launch order, you make an offer to purchase our products. We reserve the right to accept or reject your offer for reasons including:

  • Product unavailability (e.g., last item sold to another customer).
  • Suspected fraud (e.g., mismatched billing/delivery addresses, high-risk IP).
  • Inaccurate product information (e.g., pricing error, misleading description).
  • Violation of these Terms (e.g., history of fraudulent orders).

If we reject your offer, we notify you via email within 24 hours and refund any payment within 3 business days.

6.2 Order Confirmation

Your order is only confirmed when you receive an “Order Confirmation” email (sent to your provided email address). This email includes:

  • Product details (name, quantity, price, customizations).
  • Shipping/billing addresses and payment method (last 4 digits of the card).
  • Total amount (product cost + tax + shipping).

If you do not receive a confirmation email within 24 hours:

  1. Check your spam/junk folder.
  2. Verify your email address (log in to your account to confirm).
  3. Contact support@abiotp.store with your name, order date, and products to verify status.

6.3 Order Changes & Cancellations

  • Before Shipping: You may request changes (e.g., address, quantity) or cancellation via email (support@abiotp.store) only if the order is not yet shipped. We confirm approved changes/cancellations via email—we cannot guarantee changes for orders in “Processing” status (e.g., being packed).
  • After Shipping: Once shipped (you receive a “Shipment Confirmation” email with tracking), no changes/cancellations are possible. You must follow the Return Policy to return the product post-delivery.

7. Billing & Payment (Post-Launch)

7.1 Billing Information

You agree to provide true, accurate billing details when placing an order:

  • Full name as it appears on your payment method.
  • Billing address matching the one on file with your payment provider (discrepancies may cause payment decline).
  • Payment method details (e.g., credit card number, CVV, PayPal ID).

We use this information to verify your payment method and comply with financial regulations (AML, PCI DSS). Inaccurate details may delay or cancel your order.

7.2 Accepted Payment Methods

We accept the following post-launch payment methods (displayed at checkout):

  • Credit Cards: Visa, Mastercard, American Express, Discover.
  • Debit Cards: Cards with Visa/Mastercard logos (must be enabled for online purchases).
  • Third-Party Services: PayPal, Apple Pay, Google Pay.

All payments are processed by PCI DSS-compliant providers—we never store full credit card details on our servers.

7.3 Payment Authorization

By placing an order, you authorize us to:

  • Charge your selected payment method for the total order amount (product + tax + shipping + fees like gift wrap).
  • Place a temporary $1 hold to verify funds (released within 1–3 business days if the order is canceled/declined).
  • Reattempt payment twice within 48 hours if the initial charge is declined (e.g., insufficient funds).

If payment is declined, you must provide an alternative method within 7 days—unresolved declines will result in order cancellation.

7.4 Billing Disputes

If you believe you were charged incorrectly (e.g., double-charged, charged for a canceled order), contact support@abiotp.store first (before filing a chargeback) with your order number, dispute description, and supporting documentation (e.g., bank statement screenshot). We investigate within 3 business days and issue a refund if the charge is incorrect.

Unauthorized chargebacks may result in a $25–$50 fee (passed on from our payment provider) and account termination if abused.

8. Disclaimer of Warranties

THE SITE (PRE-LAUNCH AND POST-LAUNCH), POST-LAUNCH PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. ABIOTP.STORE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

8.1 Implied Warranties

  • Merchantability: Post-launch products will be fit for ordinary use (e.g., a mug holds liquid) but not free from minor defects (e.g., a small scratch on a bag) that do not affect functionality.
  • Fitness for a Particular Purpose: Products will meet your specific needs only if you explicitly informed us of those needs pre-purchase and we confirmed in writing the product would meet them.
  • Accuracy: Pre-launch details (launch timelines) and post-launch product information may have minor errors (e.g., typographical mistakes).
  • Title: We warrant we have the right to sell post-launch products and they are free from third-party claims (e.g., liens, intellectual property disputes).

8.2 Express Warranties

We provide express warranties only if explicitly stated in writing on post-launch product pages (e.g., “1-Year Warranty Against Manufacturing Defects”). Such warranties are limited to the stated terms (e.g., duration, covered defects) and do not cover damage from misuse, neglect, or normal wear.

Your use of the Site and post-launch products is at your sole risk. We are not liable for dissatisfaction, site downtime, or third-party errors (e.g., shipping carrier delays).

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY U.S. LAW, ABIOTP.STORE, ITS EMPLOYEES, DIRECTORS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, PRE-LAUNCH UPDATES, OR POST-LAUNCH PRODUCTS/SERVICES. This includes:

  • Damages from product defects (e.g., a broken accessory—our liability is limited to replacement/refund).
  • Loss of profits (e.g., a delayed order preventing resale).
  • Inconvenience or emotional distress (e.g., frustration from delayed launch access).
  • Damages from third-party actions (e.g., a shipping carrier losing your package).

Exceptions: We may be liable for personal injury/property damage caused by our intentional misconduct or gross negligence (e.g., selling a hazardous product). In such cases, liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless abiotp.store, its employees, directors, and agents from any claim, loss, damage, liability, or expense (including reasonable attorneys’ fees) arising from:

  • Your violation of these Terms or applicable laws (e.g., copyright infringement, fraud).

11. Severability

If any provision of these Terms is found unlawful, void, or unenforceable by a court, the remaining provisions shall remain in full force and effect. For example, if a court invalidates our liability limitation for indirect damages, other Terms (e.g., order confirmation rules) still apply.

12. Termination

These Terms are effective until terminated by you or us:

You may terminate by:

Termination does not relieve you of obligations incurred before termination (e.g., unpaid orders).

12.2 Termination by Us

We may terminate immediately without notice if:

  • You provide false information (e.g., fake email for pre-launch updates).
  • Your use poses a risk to us/other users (e.g., account linked to a data breach).

Upon termination:

  • You must stop using the Site.
  • We may delete/deactivate your account.
  • You remain liable for amounts owed up to termination.

13. Governing Law & Disputes

13.1 Governing Law

These Terms are governed by the laws of the State of California, U.S.A., without regard to conflict of laws principles.

13.2 Dispute Resolution

  • Informal Resolution: Before legal action, contact support@abiotp.store to resolve disputes (e.g., product defects, launch delays) informally—we respond within 5 business days and work to reach a solution (refund, replacement).
  • Small Claims Court: If informal resolution fails, you may file a claim in small claims court (your county of residence or Los Angeles County, CA) for claims within the court’s jurisdiction (typically $10,000 or less).
  • Class Action Waiver: You may not bring class/collective actions—disputes must be individual.
  • Arbitration (Optional): Unresolved disputes may be submitted to binding arbitration (American Arbitration Association rules) instead of litigation—you may opt out of arbitration within 30 days of first using the Site by emailing support@abiotp.store with “Arbitration Opt-Out” in the subject line.

Statute of Limitations: All claims must be filed within 1 year of the claim arising.

14. Changes to These Terms
